1. Preamble
These general terms and conditions of sale govern the commercial relationship between the website www.bonsaigalinou.com of SARL Bonsaï Jardins et Production and its customer, who accepts them without reservation.
The customer acknowledges having read, before payment, the general terms and conditions of sale set out on the website. These apply exclusively to all orders placed via the website.
2. Prices and Payment
Our prices are expressed in euros, all taxes included, and include:
- The product
- Packaging and handling costs
- Shipping costs
Our prices do not include delivery costs, which represent:
- Logistics tracking by the carrier
- Arranging an appointment with the customer for personal delivery
The order validated by the customer will only be considered effective once the bank payment centers have given their approval. In the event of refusal, the order will be automatically canceled.
For orders paid by bank transfer or check, payment must reach us within a maximum of 3 business days following order validation. If the transfer is not received within this time period, the order will be automatically canceled without notice.
No tree or product may be reserved without a deposit or full payment via the website. Any unpaid reservation request will be automatically refused.
3. Retention of Title
The products remain the property of SARL Bonsaï Jardins et Production until they have been paid in full.
4. Products and Warranties
All products presented on the website are individualized: the photos are contractually binding and correspond exactly to the item ordered. However, seasonal variations may occur (leaf loss, color, growth).
Live plants are not covered by a warranty, as we have no control over the growing conditions applied by the customer.
5. Shipping
Each order will be shipped only after payment has been confirmed by our bank.
SARL Bonsaï Jardins et Production cannot be held responsible in the event of force majeure: war, riots, fire, strikes, bad weather, accidents, etc.
Shipping is carried out on Mondays, Tuesdays, Wednesdays, and Thursdays to avoid warehouse storage on weekends.
In the event of extreme heat or cold, shipping may be postponed. The customer will be informed.
6. Delivery
The customer can choose to collect their order from the nursery or have it delivered to the address of their choice.
The carrier, selected by us, will arrange a meeting with the customer. The package must be opened in front of the delivery person to check the condition of the bonsai and other items.
In the event of damage or missing products, you must state specific reservations on the delivery receipt. No claims will be accepted if the package has not been opened in front of the driver.
7. Cancellation
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days from delivery to return, at their own expense, an unused product in its original packaging.

Cash on delivery returns are not accepted.
Refunds will be issued within 14 days of receipt of the returned product.
Beyond this period, all products will be deemed compliant and accepted.
8. Legal Information and Personal Data Protection
The customer's personal data is essential to process the order.
It will never be shared with third parties.
In accordance with the French Data Protection Act (No. 78-17 of January 6, 1978), the customer has the right to access, modify, rectify, and delete their data.
9. Applicable Law and Disputes
The contract is subject to French law.
Any dispute must be reported by registered mail within 48 hours of receipt. After this deadline, no claims will be considered.
