General Terms and Conditions of Sale.

 

  1.     Preamble:

These general terms and conditions of sale govern the commercial relations between the www.bonsaigalinou.com  site  of the Company SARL Bonsaï Jardin Production and its customer, who declares to accept them without reservation.

The customer acknowledges having read the general  terms and conditions of sale set out on the wwww website before payment. bonsaigalinou.com. These terms and conditions apply exclusively to all orders placed via the www.bonsaigalinou.com website.

 

  1.     Prices and payments:  

 Our prices are expressed in Euros, all taxes included, including :

-                      The product.

-                      Packaging and handling costs.

-                      Transportation costs.

Our prices do not include shipping costs, which represent :

- Logistical follow-up                      of the carrier.

-                      Making an appointment with the customer for a personal delivery.

The order validated by the Client will only be considered effective when the bank payment centres concerned have given their consent. In case of refusal by the said centres, the order will be automatically cancelled.

 

  1.     Retention of title :

The item for sale remains the property until it has been paid for in full.

 

  1.   Products & Warranties :

All our products presented on the website are individualized. The photos are contractual, the object you order on the Internet is exactly the one you will receive. However, some products may have seasonal nuances since our plants evolve over the course of the year (leaf drop, colour variation, spring shoots).

Live plants are not covered by a warranty. As we do not control the cultivation conditions used by our customers, we cannot guarantee a take-back.

 

  1.     Expedition:

Each order will only be shipped after confirmation by our bank that it has been paid.

SARL Bonsaï Jardins Production will in any case be released from its liability in the event of the occurrence of a case of force majeure such as : war, riot, fire, strikes, accidents.

In a constant concern for quality and with the aim of protecting our customers from possible problems related to transport, the departures of our company of the ordered goods will take place on Monday, Tuesday and Wednesday, in order to avoid too long a wait in the warehouses during the weekend.

During periods of extreme cold or summer heat, we will notify our customers of a postponement of  the shipment.

 

  1.     Delivery :

The customer can either pick up their order from our nursery, or have it delivered to the address of their choice. The option chosen by the customer must be indicated when ordering.

The carrier is chosen by SARL Bonsaï Jardins Production to deliver the orders of our customers who have chosen this option. To ensure that the customer receives their order in person, the carrier will ask the customer to choose a date for a time slot for the delivery person. Please note : please open the package in front of the driver to check if the bonsai, its pottery, and if applicable, the other goods ordered are in good condition. No appeal will be accepted if the package has not been opened in front of the driver. In the event of damage or missing packages, you must make precise and well-defined reservations on the receipt.  

 

  1.     Withdrawal :

In accordance with the provisions of articles L121-20 et seq. of the Consumer Code, the customer has 14 days from the date of delivery to return the product at his own expense in its original packaging for replacement or refund. The return will only be accepted if the product has not been unpacked/used.

No cash on delivery returns will be accepted.

Return shipping costs are the sole responsibility of the customer. The refund will be made within a maximum of 14 days following the date on which the customer exercised his right of withdrawal. Any product not returned at the end of the 14-day withdrawal period will be deemed to be in conformity with the order and accepted by the buyer.

 

8. Legal information and protection of personal data:

Personal information relating to the customer is essential for the processing and routing of orders.

Under no circumstances will this data be reused outside of our company or distributed to anyone. Failure to provide information will result in the order not being validated.

In accordance with the French  Data Protection Act, the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL).

In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, you have the right to access, consult, modify, rectify or delete the data you have provided to us from our Customer Service.


9. Governing Law and Disputes :

This contract is subject to French law.

Any dispute that may arise must be declared within 48 hours by registered mail. After this period, no appeal will be taken into account.
